Terms of Service

These Terms of Service ("Terms") govern your access to and use of ArchiChecker's websites, applications, and related services (the "Services"). By accessing or using the Services, you agree to these Terms. Use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and protect your information.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. The Services. ArchiChecker provides AI-assisted QA/QC tools intended to help review drawing CD sets and related project documents by producing outputs such as issue lists, severity groupings, and other workflow aids. The Services may also include an ArchiChecker add-in for Autodesk Revit. The add-in is installed on your machine in Revit; when you use it, it extracts structured data from your Revit project and transmits that data to ArchiChecker's web application, where checks and analysis are performed and results are stored in your account. Access may include free trials or a free tier; such use is governed by these Terms in the same way as paid use. ArchiChecker is a technology tool, not a licensed architecture, engineering, or construction firm. AI-powered review supplements—but does not replace—licensed professionals. Important: The Services are a productivity tool and do not replace professional judgment. You are responsible for verifying outputs and making all final decisions. ArchiChecker does not provide Revit or other Autodesk software; your use of Revit remains subject to your agreement with Autodesk.

2. Eligibility and Accounts. You must provide accurate account information and maintain the security of your login credentials. You are responsible for all activity under your account.

3. Customer Content. A. Ownership. You retain ownership of content you upload, submit, or transmit to the Services ("Customer Content"), including PDFs, other files, and data extracted from Revit and sent through the ArchiChecker Revit add-in. B. License to operate the Services. You grant ArchiChecker a non-exclusive, worldwide license to host, store, process, reproduce, and display Customer Content solely as necessary to provide, maintain, and secure the Services, including generating outputs you request. C. Your responsibilities. You represent and warrant that: you have all rights necessary to upload, transmit, and use Customer Content in the Services (including authority to extract and send Revit project data to the Services where you use the add-in); and your Customer Content and use of the Services complies with applicable law, your agreements with third parties (such as Autodesk), and these Terms.

4. Acceptable Use. You agree not to: use the Services for unlawful, infringing, or harmful activity; upload malicious code or attempt to disrupt the Services; attempt to gain unauthorized access to systems or data; reverse engineer, decompile, or attempt to extract source code or underlying models (except to the extent prohibited by law); use the Services to develop or improve competing products through systematic extraction or scraping of outputs; or abuse rate limits or bypass access controls. We may suspend or terminate access for violations.

5. AI Outputs and Disclaimers. A. AI limitations. Outputs generated by the Services may be inaccurate, incomplete, or unsuitable for your specific use case. The Services may not identify all issues, conflicts, or omissions. B. No professional advice. The Services and outputs do not constitute architectural, engineering, legal, code compliance, or other professional advice. You must rely on qualified professionals for final review and decision-making.

Descriptions of what each check type may detect (for example, on our checker types or product pages) are not guarantees. The Services can miss issues, conflicts, or compliance gaps, and may not cover every item described. You are responsible for independent verification and for all decisions based on or despite the outputs.

6. Third-Party Services. The Services may rely on third-party providers (for example, authentication, hosting, and AI processing). Your use of those components may be subject to third-party terms and policies. If you use the Revit add-in, Autodesk Revit and related Autodesk services are third-party products governed by Autodesk's terms and licenses; ArchiChecker is not responsible for Autodesk software or services. We are not responsible for third-party services outside our control.

7. Fees, Billing, Renewals, Cancellations, and Refunds. A. Billing provider. Paid plans (if offered) are billed through our billing and authentication providers (for example, Clerk and its payment processing partners). You authorize us (and our providers) to charge your payment method for applicable fees, taxes, and charges. B. Subscriptions and renewals. If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before renewal through your account settings or billing portal (where available). C. Cancellations. You may cancel at any time. Cancellation stops future renewals; you will retain access until the end of the then-current billing period unless otherwise stated at purchase. D. No refunds (payments final). All fees are non-refundable and final to the maximum extent permitted by law, including for partially used billing periods, unused usage allotments, or if you stop using the Services. E. Failed payments; loss of access. If a payment is declined, reversed, or otherwise fails, we may: suspend or limit access to paid features, downgrade your account to a free tier (if available), and/or suspend the Services until payment is successfully processed. F. Taxes. Fees may exclude applicable taxes (such as sales tax, VAT, or similar), unless stated otherwise. You are responsible for any applicable taxes, duties, or government assessments, except taxes based on ArchiChecker's net income. G. Chargebacks and disputes. If you initiate a chargeback or payment dispute, we may suspend access to the Services while the dispute is resolved. We also reserve the right to provide documentation to payment processors to respond to disputes.

8. Suspension and Termination. You may stop using the Services at any time and may be able to delete your account through account management. We may suspend or terminate access to the Services immediately if: you violate these Terms, your use poses a security risk, or we are required to do so by law.

9. Data Deletion Requests. Account deletion may remove your authentication profile via our authentication provider. Deletion of Customer Content stored within the Services (including uploaded files, Revit-derived data we hold, and related project data) is handled by request. To request deletion of Customer Content, contact us at support@archichecker.com. We may retain limited data as required for legal compliance, security, fraud prevention, and legitimate business purposes.

10. Intellectual Property. We retain all rights, title, and interest in the Services, including software, design, branding, and documentation, excluding Customer Content. You may not use our trademarks without permission.

11. Warranty Disclaimer. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHICHECKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW: ARCHICHECKER IS NOT LIABLE FOR ANY ERRORS, MISTAKES, OMISSIONS, OR ISSUES ARISING AT ANY STEP OF THE PROCESS—INCLUDING UPLOAD, PROCESSING, OUTPUT GENERATION, OR YOUR RELIANCE ON THE SERVICES OR OUTPUTS. ARCHICHECKER IS NOT LIABLE FOR ANY COSTS OF FIXING, REWORK, REMEDIATION, CORRECTION, OR SIMILAR DAMAGES (INCLUDING BUT NOT LIMITED TO DESIGN CHANGES, CONSTRUCTION COSTS, OR OTHER EXPENSES). ARCHICHECKER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. ARCHICHECKER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO ARCHICHECKER FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS), WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so these may not apply to you.

13. Indemnification. You agree to indemnify and hold harmless ArchiChecker and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: your Customer Content, your use of the Services, or your violation of these Terms or applicable law.

14. Governing Law. These Terms are governed by the laws of [Arizona, USA], without regard to conflict of law rules.

15. Changes to the Terms. We may update these Terms from time to time. If we make material changes, we will update the Effective date and may provide additional notice.
